Welcome to linqsecure.linqgroup.io. This website (the “Site”) is operated by Linq Group, Inc. (“Linq”). The Site facilitates utility token locking, token distribution, and interactions with cryptocurrency wallets through blockchain networks such as Ethereum. By accessing or using the Site, you agree to these Terms and Conditions (“Terms”).

Platform Purpose

Facilitate connections with cryptocurrency wallets.

Support the locking and distribution of utility tokens via smart contracts on blockchain networks.

Define user and platform responsibilities regarding interactions with blockchain technology.

Address the risks inherent in using decentralized networks and irreversible blockchain transactions.


Privacy

Your use of the Site is subject to our Privacy Policy. Please review it to understand our data collection practices, especially regarding information like wallet addresses and transaction metadata.


Electronic Communications

By using the Site or sending communications to Linq electronically, you consent to receive electronic communications. This includes agreements, notices, and other communications required by law.


Children Under Thirteen

Linq does not knowingly collect personal information from anyone under the age of 13. Users under 18 may only use the Site with the permission of a parent or guardian.


Blockchain-Specific Clauses

Immutability of Blockchain Transactions

Transactions made through the Site are recorded on the blockchain, which is an immutable and irreversible ledger. Once a transaction is submitted to the network, it cannot be altered, reversed, or canceled. Users acknowledge that Linq has no control over the blockchain or the ability to modify transactions after they are recorded.

Risks Inherent in Blockchain Usage

By using the Site, you understand and accept the following risks:

Transaction Finality: All transactions executed via smart contracts on the Ethereum network or other blockchains are final.

Gas Fees: Users are responsible for paying any gas fees associated with token locking, transfers, or other blockchain transactions.

Volatility: Cryptocurrency values are volatile, and the value of tokens locked or distributed through the platform can fluctuate significantly.

Security: Users must take precautions to secure their cryptocurrency wallets and private keys. Linq is not responsible for any loss of funds due to user error, wallet security breaches, or fraudulent activities.

Smart Contract Bugs: Linq facilitates transactions through smart contracts. While we strive for secure implementation, we are not responsible for errors or vulnerabilities in smart contracts that could result in loss of tokens.  However, Linq will evaluate each scenario or situation that occurs from an error and make a decision on outcome with the end user.


Third-Party Integrations

The Site may facilitate connections with third-party wallet providers or exchanges. Linq does not control these third-party services and is not liable for their performance, security, or functionality. Users are responsible for reviewing and complying with the terms of any third-party services they interact with through the Site.


No Unlawful or Prohibited Use

Users are granted a non-exclusive, revocable license to use the Site in accordance with these Terms. You agree not to:

Engage in unlawful activities or use the Site for any purpose prohibited by these Terms.

Interfere with the Site’s operation or other users’ access to the Site.

Access any materials or information through unauthorized means.


User Obligations and Security

You are responsible for:

Securing your wallet and private keys: Linq does not store or manage private keys. Any loss or compromise of your wallet’s private key could result in the permanent loss of your tokens.

Ensuring the accuracy of your transactions: Before submitting any transaction, users must verify that all information, including wallet addresses and token amounts, is correct. Linq is not liable for user errors.


Indemnification

You agree to indemnify and hold Linq and its affiliates harmless from any claims, losses, liabilities, and expenses arising out of your use of the Site, any violation of these Terms, or interactions with blockchain networks.


Arbitration

If a dispute arises between you and Linq, it will be resolved through binding arbitration under the Federal Arbitration Act. This process is conducted by a neutral arbitrator, and the decision is final and enforceable in court.


Class Action Waiver

All claims must be brought on an individual basis. You agree to waive any right to participate in a class action lawsuit or any collective legal proceeding against Linq.


Liability Disclaimer

The Site, its services, and any related materials are provided “as is” without warranties. Linq disclaims liability for any errors, interruptions, or losses incurred through the use of the Site, including but not limited to:

Inaccuracies in the content or functionality of the Site.

Loss of tokens or funds due to blockchain or smart contract vulnerabilities.

Any issues caused by third-party services or integrations.

Linq is not liable for indirect, punitive, incidental, or consequential damages arising from your use of the Site.


Termination

Linq reserves the right to terminate your access to the Site without notice for violations of these Terms or if your actions compromise the security or functionality of the Site.


Jurisdiction and Governing Law

These Terms are governed by the laws of the State of Delaware. Any disputes not resolved by arbitration will be handled in Delaware courts.


Changes to Terms

Linq reserves the right to update these Terms at any time. Users are encouraged to review the Terms periodically to stay informed of any changes. Continued use of the Site constitutes acceptance of any updated Terms.
